FlightLog — Terms of Use
1. About these terms
FlightLog is published by KrimSoft, a trade name of Omnimation BV, the Netherlands ("we", "us"). These terms apply to the use of the FlightLog app on any device. By accepting them, or by using the app, you agree to them. The Disclaimer and the Privacy Policy are part of these terms.
2. Using the app
We give you a personal, non-exclusive and non-transferable right to use FlightLog to log and review flights and to support your flight preparation.
You use the app lawfully and in line with the rules of the air. You do not copy, modify, decompile or reverse engineer the app, except as far as the law expressly allows. You do not use the app, or the services it connects to, to access data that is not yours, nor in a way that harms them or other users.
2a. Your account
FlightLog needs an account. There is no password: you give an email address, we mail a code to it, and entering that code signs the app in on that device. We keep the address, which device is signed in and which plan the account is on.
The account is personal. The address is used to sign you in, to tell you about the service, and to warn you before a cloud copy is cleared away for being unused. It is never sold or passed on for advertising.
Plans are free while the app is being built. If that changes, you are told in advance and asked before anything is charged.
3. Your club's services
Some features work through a proxy set up by your club: fetching members, the fleet and your own flights from GlidingApp. Whether these are available is up to your club, and your club's own rules and agreements apply to them.
The club access code and the link to your own GlidingApp account are for you alone. Do not share them.
4. Your data and backups
Your flights and settings are kept on your phone. You are responsible for them, and for keeping backups. Keep your recovery code safe: the cloud copy is encrypted with a key made from it, so it cannot be opened without it — and neither we nor your club can recover a lost code or restore lost data. For the same reason a copy can only be erased by somebody holding the code, which the app offers under Backup & Restore.
5. Third-party data and services
The app shows data from, and connects to, services of third parties, some of them through FlightLog's data service. We do not control them, cannot guarantee that they are available or correct, and their own terms apply. Airspace and reporting points are © openAIP, under CC BY-NC 4.0.
6. No warranty
FlightLog is provided "as is" and "as available". We do not guarantee that the app works without interruption or errors, that it is fit for any particular purpose, or that the data it shows or works out is correct.
7. Liability
To the fullest extent permitted by law, KrimSoft is not liable for any damage or loss arising from the use of FlightLog or from being unable to use it — including accidents, injury, damage to aircraft or other property, fines, lost or incorrect data, and any indirect or consequential loss.
Nothing in these terms limits liability that cannot be limited under Dutch law, such as liability for damage caused by our intent or deliberate recklessness.
8. Changes
We may change these terms, the Disclaimer and the Privacy Policy. When they change, the app asks you to accept the new version before you continue. If you do not accept, stop using the app.
We may change FlightLog, or stop offering it, at any time. You may stop using it at any time by removing it from your phone.
9. Law and disputes
These terms are governed by Dutch law. Disputes are submitted to the competent court in the Netherlands, unless mandatory consumer law gives you the right to go to another court.
